Nintendo Switch Under Investigation Over Patent Violation By The International Trade Commission

If all of this sounds familiar it may be because Gamevice filed a lawsuit against Nintendo for something similar late previous year, alleging Nintendo's hardware violated patents for both Gamevice's Wikipad and its detachable controllers for mobile devices. While it was designed for a variety of devices, the Switch's Joy-Con controllers were made to work exclusively with the hybrid console.

At the time, Gamevice demanded Nintendo stop selling the Switch and pay damages, attorney fees, costs, and expenses.

Gamevice eventually dropped the lawsuit for unknown reasons.

The USITC published a statement today that said the agency is looking into Gamevice's complaint of patent infringement, which was filed on March 30, 2018.

Nintendo is under the gun with the US International Trade Commission, with another lawsuit in motion against it from accessories maker Gamevice.

Months back, a company called Gamevice took issue with Nintendo and filed a patent infringement suit against the Switch for allegedly infringing on patents relating to how controllers attach to the sides of an electronic device.

The US trade commission has not yet ruled on the validity of the complaint, but an investigation is now under way.

Gamevice has created handheld controllers that can attach to smart phones and tablets, lending you the chance to use triggers, buttons and analog sticks when playing games.

Gamevice is asking that the USITC issue "a limited exclusion order and cease and desist orders".

If Gamevice succeeds, it wants a ban on Nintendo Switch imports in the United States, which seems to be a very unlikely outcome.

So, don't be surprised if a settlement announcement is made at some point between Gamevice and Nintendo over this patent dispute, especially if the US International Trade Commission makes a decision that hurts Nintendo. The complaint will be assigned to a USITC administrative law judge who will hold an evidentiary hearing.
