#ZimConCourt to rule on MDC's election challenge on Friday

The statement by the joint mission of the International Republican Institute and the National Democratic Institute comes a day after Zimbabwe's Constitutional Court upheld President Emmerson Mnanaggwa's narrow election victory.

The MDC had accused the ruling ZANU-PF party and the election commission of rigging the July 30 vote, Zimbabwe's first poll since the ousting of Robert Mugabe previous year.

According to Malaba, the opposition alliance's presidential candidate Nelson Chamisa and the MDC didn't show any primary evidence of vote rigging by the Zimbabwe Electoral Commission.

Lawyers for the Movement for Democratic Change (MDC) launched a blistering attack on the ruling Zanu-PF party and the election commission over the July 30 ballot - Zimbabwe's first election since the ousting of Robert Mugabe past year.

THE Constitutional Court (ConCourt) yesterday declared Zanu PF leader Emmerson Mnangagwa as the duly elected President of Zimbabwe after making a determination that MDC Alliance leader Nelson Chamisa failed to provide the court with primary evidence to enable it to invalidate the declaration made by the Zimbabwe Electoral Commission (Zec).

Cde Mnangagwa won the polls with 50,67 of the total votes cast while Mr Chamisa got 44,3 percent.

Chamisa says he won the election with 2.6 million votes compared with two million for Mnangagwa but he has provided no evidence.

In a series of tweets following the verdict, MDC said his party respects the rule of law and consequently the verdict of the court.

Chamisa's comments will do little to ease tension in a country that has been caught up in disputed polls since the MDC contested its first election in 2000.

"The endorsement of a sham election by the Constitutional Court does not and can not take away your constitutional rights, including those enshrined in Section 59 of the Constitution", said Chamisa. "Your will is sacred & we'll listen to you on the path of peace & course of action to be taken to rescue our attractive Zimbabwe from the jaws of poverty, corruption & dishonesty".

President Mnangagwa contends that Mr Chamisa's petition is premised on alleged mathematical anomalies, which have no factual basis.

Derek Matyszak, a legal expert at the University of Zimbabwe, had predicted that the opposition faced an uphill struggle given the courts' historic tilt towards ZANU-PF, which has ruled since independence from British colonial rule in 1980. We call on President Mnangagwa to reach out to those who did not support him or his party in these elections, and work to build their confidence and trust.

After Mugabe's ouster, his ruling party, the Zimbabwe African National Union-Patriotic Front, retained power and Mnangagwa slid into Mugabe's seat.

Mr Mnangagwa is expected to be inaugurated within 48 hours.

The court's ruling can not be appealed.
