Trump's Battle With 'Obamacare' Moves To The Courts

Here's a rundown of where the major lawsuits stand, from cases challenging the administration's approval of Medicaid work requirements to a lawsuit arguing the Affordable Care Act is unconstitutional.

Republicans generally agree that the health care law has serious flaws, but they realize getting rid of it while Democrats control the House would leave a vacuum in place of protections for people with pre-existing medical conditions, insurance subsidies and expanded Medicaid, according to The Hill.

Over 11 million reportedly signed up for Obamacare coverage this year.

Trump has said association health plans would let Americans "escape some of Obamacare's most burdensome mandates". "So we're going to get rid of Obamacare and I said it the other day: The Republican Party will become the party of great health care".

President Donald Trump has said that certain health issues - like ending the HIV epidemic, curbing the opioid crisis and cutting high drug prices - are some of his top priorities.

A common thread in the various health care cases is that they involve lower-court rulings for now, and there's no telling how they may ultimately be decided.

"They don't have any proposal whatsoever, and in fact, many Republicans oppose this decision that came out of nowhere from the President, because many of my Republican colleagues on the Energy & Commerce Committee are working with us to try to make improvements in the health care system".

Just a day earlier, Marc Short, Vice President Mike Pence's chief of staff and the former White House legislative affairs director, claimed on CNN that "the President will be putting forward plans this year" to replace Obamacare through Congress.

The plans known as association health plans allowed sole proprietors and other business owners to band together to buy insurance at reduced rates.

It wasn't immediately clear how the Trump administration would respond, but officials have said they will keep moving ahead with the president's agenda.

U.S. District Court Judge John D. Bates last week struck down the administration's health plans for small business and sole proprietors, which allowed less generous benefits than required by the ACA. Those that have been set up are now in limbo - a Justice Department spokeswoman said after Bates' ruling that the administration is "considering all available options", including an appeal.

Association health plans also have faced opposition at the state level.

That third Republican senator also told The Hill, "Sometimes, it's easy to write off the Affordable Care Act issues as political, and certainly, there's politics to it".
