ECI temporarily bars Yogi Adityanath, Mayawati from campaigning

April FrancisApr 17, 2019

Election Commission has also barred BJP leader and Union Minister Maneka Gandhi for 48 hours and Samajwadi Party leader Azam Khan for 72 hours from poll campaigning.

The bench referred to submissions of the EC that they can issue a notice, then advisory and finally lodge a complaint against an errant politician for violating the Model Code of Conduct (MCC) by giving hate speeches based on caste and religion during campaign. In doing so, the Election Commission invoked Sections 123 and 125 of the Representation of People's Act, 1951 which penalise the promotion of communal and caste differences for electoral gains.

Retorting to Yogi's "Ali" remarks, Mayawati said people of UP should ensure that the BJP does not "get either Ali's vote or Bajrang Bali's vote".

In a speech at a rally in Saharanpur's Deoband on April 7, Mayawati had appealed to Muslims to vote for the alliance and not divide their vote by supporting another political party. On finding that the same was highly provocative and had the tone and tenor to aggravate existing differences or create mutual hatred between different religious communities, the Election Commission has barred Adityanath from carrying out electoral campaign work for a 72 -hour period starting from 6 am on April 16 (Tuesday). Congress Complains to EC Against PM's Wardha Speech, Calling It "Hateful, Divisive". "The explanation shall be submitted within 24 hours of the receipt of the notice, failing which the commission shall take a decision without further reference", Principal Secretary, Election Commission, Anuj Jaipuriar had said.

But, I think, it'll be a discussion for the umpires afterwards and I am a watcher as you guys are, for now. The incident happened during the match between Chennai Super Kings and Rajasthan Royals here.

But the Congress has taken issue with such assertions, in particular, pointing to leaked government data that showed unemployment rose to its highest level in at least 45 years in 2017/18. Ali is a revered figure in Islam and Hanuman is often called Bajrangbali.

In its order on Adityanath, the poll panel observed that being the chief minister of a state, he has an "added responsibility to not only uphold the basic tenets, including secularism, of the Constitution of India, but also to display the same in his public appearances".

The poll panel told Mayawati that being a senior leader, she should have "desisted" from making such comments that have the "undertone and propensity to polarise the elections" in several constituencies due to the reach of the media.

Khan was banned for three days, while Gandhi was banned for two days.
